I have the honour to transmit for the signi-
fication of His Majesty's pleasure the accompanying Ordinance
entitled.- An Ordinance to further amend the Magistrates
Ordinance, 1890. No. 19 of 1903.

In may last the District hagistrate in

the New Territories drew attention in a report, of which a
copy is enclosed, to the difficulty he was experiencing
dealing with cases of wives deserting their husbands.
Further enquiry showed that in some cases

the wives had returned to their parents while in others they
had gone to live with other men; and that while in some
instances cruelty and want of support by their husbands were
the causes of their desertion in others no such reasons existed
end the desertion was apparently due to the newly discovered
immunity from the consequences which under Chinese rule would
have followed such action.

I enclose copy of an extract from a minute
by Dr. Ho Kai, who was consulted in this matter, which shows
that under Chinese Law a wife who deserts her husband is
liable to severe punishment, and in view of this fact it was
